Agreement to Terms
By accessing this website or engaging flowww creative for design or development work, you agree to be bound by these Terms of Use.
Where a signed proposal, statement of work, or service agreement exists, that document governs the specifics of the engagement and these terms apply to everything not addressed there.
Our Services
flowww creative operates as a remote digital design studio offering brand, web design, and web development services. Deliverables, timelines, and scope are defined per project in a written proposal.
Work outside an agreed scope is treated as a new request and may require an additional estimate.
Client Responsibilities
Clients agree to provide timely feedback, accurate information, and any content, assets, or access required to complete the work.
Delays in feedback or asset delivery may shift project timelines. Clients confirm they hold the necessary rights to any materials supplied to us.
Fees and Payment
Fees, deposits, and payment schedules are set out in the applicable proposal or invoice. Projects typically begin once a deposit has been received.
Invoices are payable by the date stated. Unpaid balances may result in work being paused until the account is brought current.
Timelines and Revisions
Estimated timelines are provided in good faith and depend on the timely cooperation of both parties.
Each engagement includes a defined number of revision rounds. Additional revisions beyond that allowance may be quoted separately.
Intellectual Property
Final deliverables transfer to the client upon receipt of full payment, unless a proposal states otherwise.
Working files, internal processes, source components, and unused concepts remain the property of flowww creative. We reserve the right to display completed work in our portfolio unless a written confidentiality arrangement is in place.
Confidentiality
Each party agrees to keep non-public information shared during an engagement confidential and to use it only for the purposes of the project.
Warranties and Disclaimers
Services are provided with reasonable professional skill and care. The website and its content are provided on an “as is” basis without warranties of any kind.
We do not warrant uninterrupted availability of third-party platforms, hosting services, or integrations used in a project.
Limitation of Liability
To the fullest extent permitted by law, flowww creative is not liable for indirect, incidental, or consequential losses, including lost profits or lost data, arising from use of this website or our services.
Our total liability in connection with an engagement is limited to the fees paid for that engagement.
Governing Law
These Terms of Use are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein. The courts of Saskatchewan have exclusive jurisdiction over any dispute arising from these terms.
Changes to These Terms
We may revise these terms at any time. Continued use of the website or our services after changes are posted constitutes acceptance of the revised terms.
